Terms of Service

These Terms of Service (the "Terms") govern your access to and use of MartBooks (the "Service"), operated by Fincepto Solutions Nigeria Limited ("Fincepto", "we", "us"), a company registered in Nigeria. By creating an account, you accept these Terms in full. If you don't accept them, don't use the Service.

1. Account, trial, and billing

  • A 7-day free trial is available on every plan. No card required to start.
  • Subscriptions renew automatically each month unless cancelled before the renewal date.
  • Prices are shown in USD; local charges are converted using the FX rate at time of purchase.
  • You are responsible for keeping your account credentials secure. We recommend enabling multi-factor authentication.

2. Your data

  • Data you upload (products, customers, sales, journals) belongs to you.
  • We host it, back it up nightly, and give you an export whenever you ask.
  • We do not sell your data. We do not train third-party AI on your data.
  • Our handling of personal data is governed by our Privacy Policy.

3. Acceptable use

  • Don't use MartBooks to process illegal transactions or launder money.
  • Don't try to reverse-engineer, resell, or sublicense the Service.
  • Don't abuse rate limits, run stress tests without approval, or attempt to breach other tenants' data.

4. Availability

We target 99.9% uptime measured monthly, excluding scheduled maintenance announced ≥ 24 hours in advance. The Service includes an offline-first POS mode so that momentary network outages do not stop your business from ringing up sales.

5. Termination

You may cancel your subscription at any time from the billing dashboard. We may suspend or terminate an account that violates these Terms after giving you a reasonable opportunity to fix the violation, or immediately for severe violations (fraud, security breach, illegal activity).

On termination, your data remains exportable for 30 days, after which it is permanently deleted. Backups are purged within a further 60 days.

7. Limitation of liability

To the maximum extent permitted by Nigerian law, our aggregate liability for any claim arising out of the Service is capped at the fees you paid in the twelve (12) months preceding the event giving rise to the claim. Neither party is liable for indirect, consequential, or punitive damages.

8. Changes

We may update these Terms. Material changes are announced by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes are heard in the courts of Lagos State.
